Terms of Service

1. Acceptance of Terms
These Terms are an agreement between you and Monster Hub Pty Ltd, doing business as Fork Time ("Fork Time," "we," "us," or "our"). By creating an account, forwarding your phone number to Fork Time, or otherwise accessing or using the Fork Time platform, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. You must be at least 18 years old and using the Service for a business to use the Service.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@forktime.ai of any unauthorised use of your account or any other breach of security. Fork Time is not liable for any loss or damage arising from your failure to protect your account credentials.
3. Fees and Payment
The Service is a paid subscription priced per restaurant location in United States dollars, with current pricing published at forktime.ai/pricing. There are no per-cover, per-booking or commission fees on any plan. Standard restaurant usage is unlimited and governed by our Fair Use Policy at forktime.ai/fair-use.
Trial: Every plan includes a 14-day free trial, limited to one per restaurant location, with no payment card required. Trials of plans that include AI answering begin once a phone number has been provisioned during setup. The trial never converts to paid billing on its own: if no card is added by the end of the trial, the account pauses, nothing is charged, and your Restaurant Data is retained for export.
Billing: Paid subscriptions begin when you add a card, bill monthly in advance on that date, and renew each month until cancelled. Upgrades take effect immediately; downgrades take effect from the next billing cycle. You may cancel at any time from your account, and cancellation takes effect at the end of the current paid period, with no further charges.
Failed payments: If a payment fails we retry the card twice over the following days and email you each time. If payment still fails, AI answering may be suspended after 7 days' email notice until payment is updated; your bookings, guest records and account access are unaffected during that period.
Fees are non-refundable except as required by law. We may change pricing with at least 30 days' prior notice for future billing periods, never retroactively for a period already paid.
4. Your Content and Data
Your restaurant retains ownership of all data you and your guests submit to the Service, including guest profiles, visit histories, preferences, bookings and conversation records ("Restaurant Data"). You grant Fork Time a limited, non-exclusive licence to process, store and use Restaurant Data solely to provide and improve the Service. We do not sell Restaurant Data, and we do not use Restaurant Data to train generalised AI models. "Improving the Service" means diagnostics, quality review and product analytics in connection with your own account, and never means training generalised models on Restaurant Data. If you leave the Service, your Restaurant Data exports in full.
5. Guest Calls and Messaging
The Service answers calls and sends SMS, WhatsApp and email messages to your guests on your behalf: booking confirmations, reminders, waitlist and recovery offers, and replies to guest enquiries.
Consent: You confirm that guest contact details you provide, and the guests who contact your restaurant through the Service, are a lawful basis for these transactional communications under the Spam Act 2003 (Cth) and other applicable law. Marketing messages are sent only where you have the guest's consent.
Opt-out: Guests may opt out of SMS at any time by replying STOP. Once a guest opts out, the Service ceases messaging that number unless the guest opts back in.
Call recording: Calls answered by the Service are recorded and transcribed to complete bookings and provide the Service. Recordings are deleted 30 days after the call; transcripts and the booking records created from them are retained as part of Restaurant Data. Recording-notice requirements vary by jurisdiction and are your responsibility as the venue. The Service includes a recording disclosure that plays at the start of answered calls; it is enabled by default and you may only disable it where the law that applies to your venue permits recording without notice.
Message and data rates may apply to guests, and carriers are not liable for delayed or undelivered messages. You agree not to use the Service's messaging features to send unlawful content or messages to people who are not your guests.
6. AI Services
Parts of the Service are performed by AI, including phone answering, message replies, booking risk assessment, recovery ranking and seating recommendations. The AI answers only from restaurant knowledge you have approved, and transfers to your team or creates a callback when it cannot answer confidently. Your restaurant sets and can override booking rules, deposit thresholds and seating decisions, and recovery offers are sent by your team. Compatible AI assistants may check availability and complete bookings through our MCP server, with your booking and deposit rules applied.
7. Deposits and Guest Payments
Card holds and deposits are processed through Stripe between the guest and your restaurant. Fork Time does not hold guest funds. A guest card is charged only when your team marks the booking as a no-show under the policy you configure. You are responsible for your deposit policy complying with the law that applies to your venue.
8. Prohibited Uses
You agree not to: use the Service for any unlawful purpose or in violation of any applicable law; use the messaging features to send spam or unsolicited marketing; reverse engineer, decompile or otherwise attempt to derive the source code of the Service; access or attempt to access another customer's account without authorisation; interfere with or disrupt the integrity or performance of the Service; upload content that is harmful, offensive or infringes the rights of others; resell, sublicense or provide access to the Service to third parties without authorisation; or input fraudulent or intentionally inaccurate data into the Service.
9. Intellectual Property
The Service, including all software, models, user interface, documentation and related materials, is owned by or licensed to Fork Time and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service during your subscription term. You may not copy, modify, distribute or create derivative works based on the Service.
10. Privacy
Your use of the Service is also governed by our Privacy Policy at forktime.ai/privacy, which describes how we collect, use and protect information, including guest call recordings and our subprocessors. By using the Service you acknowledge that you have read and understood our Privacy Policy.
11. Data Protection and Security
Retention: call recordings are deleted 30 days after the call; booking records, guest profiles and other Restaurant Data are retained for the life of your account and for the 30-day export window after termination. You may request deletion of specific records at any time, and we action lawful deletion requests without undue delay. We maintain routine encrypted backups, which expire on their own cycle after deletion.
Security and breach notice: we protect Restaurant Data with industry-standard technical and organisational measures. If we confirm a data breach affecting your Restaurant Data, we will notify you within 72 hours of confirmation with what we know and what we are doing, and comply with any notification obligations under applicable law.
Hosting and subprocessors: the Service runs on cloud infrastructure, and we use a small number of service providers to deliver it, including payment processing, telephony, speech and voice processing, messaging and hosting. The current list of subprocessors and hosting regions is published at forktime.ai/subprocessors and updated there before any material change.
12. Third-Party Services
The Service depends on third-party services to operate, including Stripe for payments, telecommunications carriers for calls and SMS, WhatsApp for WhatsApp messaging, POS and ordering partners you connect, and compatible AI assistants that book through our MCP server. Those services are governed by their own terms, and Fork Time is not responsible for their acts, omissions or outages, which are treated as availability events under these Terms.
13. Availability, Maintenance and Force Majeure
We aim to keep the Service available continuously but do not guarantee uninterrupted operation. We may perform scheduled maintenance, and will time material maintenance outside typical service hours where practicable. We may modify the Service over time; if a change materially reduces core functionality you pay for, we will give you reasonable prior notice. Neither party is liable for delay or failure caused by events beyond its reasonable control, including carrier outages, internet failures, natural disasters or government action, except for your obligation to pay fees already due.
14. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. Fork Time does not warrant that the Service will be uninterrupted, error-free or secure, and makes no warranty regarding the accuracy of any AI-generated output, the outcome of any booking risk assessment, the successful delivery of any call or message, or that any cancelled table will be refilled. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded.
15. Limitation of Liability
To the maximum extent permitted by law, Fork Time shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data, bookings, business opportunities or goodwill, arising out of or related to these Terms or your use of the Service, regardless of the theory of liability. Fork Time's total aggregate liability arising out of or related to these Terms or the Service shall not exceed the amounts paid by you to Fork Time in the twelve (12) months immediately preceding the event giving rise to the claim. Where liability cannot be excluded but can be limited, Fork Time's liability is limited to resupplying the Service or paying the cost of having the Service resupplied.
16. Indemnification
You agree to indemnify, defend and hold harmless Fork Time, its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or any applicable law; (c) your failure to hold a lawful basis for communications sent to your guests through the Service; (d) your deposit, cancellation or no-show policies; or (e) any claim by a guest or other third party related to messages sent or calls answered through the Service on your behalf.
17. Termination
You may cancel at any time as described in Section 3, effective at the end of the current paid period. Fork Time may suspend or terminate your access immediately if you breach these Terms, fail to pay fees when due, or if continued use poses a legal or security risk. Upon termination, you will have 30 days to export your Restaurant Data. After that period, we may delete your data in accordance with our Privacy Policy. Sections 4, 9, 11, 14, 15 and 16 survive termination.
18. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any dispute arising under these Terms shall first be attempted to be resolved informally by contacting support@forktime.ai. If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts of Queensland, Australia.
